The work is performed and signed by Mohamed Elansary, PhD (Environmental Engineering, Texas A&M University-Kingsville, 2022). He is not a licensed Professional Engineer, not an attorney, and not a certified public accountant. Nothing VES provides is legal, accounting, or engineering advice, and nothing here creates an attorney-client relationship.
You send records you already have — pay applications (G702/G703), schedule of values, invoices, change orders and change-order requests, certified payroll (WH-347), sign-in and clock records, subcontracts, purchase orders.
We read them and tie them to each other:
The findings memo. The first deliverable is a written findings memo, normally within two business days of receiving one job's records. Every figure in it names the file it was read from. Anything that cannot be sourced from your own files is listed as a question for you rather than stated as a fact. The first findings memo is free and carries no obligation: if it finds nothing you can bill, you owe nothing and you keep the memo.
The build (the paid work). If you buy the flat build, we prepare one pay-application package for one job — the application form, the continuation sheet, the supporting reconciliation, and a list of the backup documents it relies on — ready for your signature.
What we do not do. We do not sign, submit, file, transmit, certify, or send anything to a general contractor, an owner, a lender, an agency, or anyone else. The document is delivered to you. You review it, you sign it, you send it, or you do not. Nothing is filed without your approval. We do not represent you before any agency and we do not give an opinion on the merits of any claim, lien, or dispute.
You choose one:
Option A — flat build: $1,500 (one time, per job). Payable at checkout. Covers one pay-application package for one job, prepared from the records you send, ready for your signature. It is not a subscription and it does not renew.
Option B — 10% of what you collect. No fee at checkout and no fee at any point unless money is collected.
What "collect" means. "Collect" means money actually received by you — cleared into your account — on an item this desk identified in writing in a findings memo or a build delivered to you, where you confirm receipt in writing (an email is enough). It is not money billed, not money approved, not money promised, not a lien filed, not a settlement figure, and not the value of a change order accepted into a contract sum. If nothing is received, nothing is owed. The 10% is invoiced only after your written confirmation, never automatically, and never in advance. It is a one-time fee on that receipt, not a recurring share.
No promises about outcome. VES does not promise, guarantee, or predict that you will collect, recover, or be paid anything. What we do promise is what we will not charge: if the memo finds nothing you can bill, you owe nothing.
A note on the monthly desk. A continuing weekly desk at $1,500 per month, cancellable at any time, exists as a separate arrangement. It is never part of this checkout and it is offered only after a first flat build or a first confirmed collection. Buying under these terms does not enrol you in it and does not create any recurring charge.
Money terms. No interest, no finance charges, and no late fees are charged on anything, ever. Prices are in US dollars. Payment is processed by Stripe; VES does not see or store your card number. Taxes, if any apply, are your responsibility.
The work is only as good as the records. VES reads what you provide and states what those documents show. VES does not audit, verify with third parties, or independently confirm the accuracy of records you supply, and does not decide what you should bill. Every figure is yours to review before you sign or send anything.
To the maximum extent Texas law allows, VES's total liability arising out of or relating to this agreement is limited to the fees you actually paid VES for the work at issue. VES is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost claims, or amounts you did not collect. Nothing in this section limits liability for fraud or for anything that cannot be limited by law.
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Denton County, Texas, and both sides consent to that venue. Each side pays its own costs.
